Video provided to CBS 17 shows the moments before a Fayetteville man was arrested outside of a Warsaw Waffle House earlier this month. 

A previously released video that showed Anthony Wall being arrested on May 5 went viral with many being critical of the arresting officer’s actions.

Police were checking out a call about a fight and ended up arresting the 22-year-old Wall as he was dressed in a tuxedo. Wall had just taken his sister to the prom.

In a video posted on Facebook, Warsaw mayor A.J. Connors said Wall was being disruptive and belligerent.

Connors praised the arrest and twice denied that race played a role.

“We must understand that this young man broke the law,” Connors said. “He was there. He started a fight — this officer did what he had to do.”  

In a statement from the police department, investigators say they didn’t know how rough the arrest was until Wednesday, which is around the time the video was getting national attention.

On Monday, Wall’s attorney, Ben Crump was critical not only of the officer’s actions but of Waffle House as well. 

“It was the Waffle House employees who used homophobic slurs,” Crump said during a news conference.

Wall is facing charges of disorderly conduct and resisting arrest.

Police say the SBI and FBI are both investigating.
